This website is operated by the Ugly Duckling Company Ltd T/A Róisín O’Shea Fine Arts, and sells licensed reproductions of work and original paintings/drawings by artist Róisín O’Shea. This website is the Official Website of the artist.

The company offers this website, including all information, tools and services available from this site to you, the user, subject to your acceptance of all terms, conditions, policies and notices stated here. Please read these Terms of Service carefully before using our website. By accessing or using any part of the site, you agree to be bound by our Terms of Service.

  1. ONLINE STORE TERMS

By agreeing to these Terms of Service, you confirm that you are over 18 years of age.

You may not use our products for any illegal or unauthorised purpose nor may you, in the use of the Service, violate any laws in your jurisdiction, including but not limited to copyright laws.

  1. GENERAL CONDITIONS

We reserve the right to refuse service to anyone for any reason at any time.
You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the website or any licensed image posted on the website, or any licensed product purchased on the website, without express written permission from our company.

  1. MODIFICATIONS TO THE SERVICE AND PRICES

Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time. We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

  1. PRODUCTS OR SERVICES

Certain products or services may be available exclusively online through the website. These products or services may have limited quantities and are subject to return or exchange only according to our Return Policy. We have made every effort to display as accurately as possible the colours and images of our products that appear in our shop. We cannot guarantee that your computer monitor’s display of any colour will be accurate, but can confirm that all reproductions are approved by the artist.

We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. We reserve the right to discontinue any product at any time.

  1. ACCURACY OF BILLING AND ACCOUNT INFORMATION

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we will attempt to notify you by contacting the e‑mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

  1. SHIPPING

All orders are processed within 10 business days (excluding weekends and holidays) after receiving your order confirmation email. You will receive another notification when your order has shipped. We print, frame and pack to order and will ship (excluding commissioned works) as soon as possible from our studio in Waterford. Commissioned works are subject to a separate contract and will have an agreed delivery date.

We use An Post (Irish postal service) for all online orders which allows us to provide reliable and trackable delivery services to our customers. Orders within Ireland are usually delivered within 1 -3 days, but may take longer during busy seasons. International shipping times can vary based on the destination country and its custom procedures. If you have a date by which you would like your order to be delivered please contact us at info@roisinoshea.com to check if that is possible.

Please ensure that your shipping address is accurate and complete to avoid any delays. We are not responsible for orders that are shipped to incorrect or incomplete addresses provided by the customer. When your order has shipped, you will receive an email notification from us which will in most cases include a tracking number you can use to check its status. Please allow 48 hours for the tracking information to become available.

If you haven’t received your order within 21 days of receiving your shipping confirmation email, please contact info@roisinoshea.com with your name and order number, and we will look into it for you.

  1. RETURNS POLICY

We have a 14-day return policy, which means you have 14 days after receiving your item to request a return. Where the item is shipped within the European Union you have the right to cancel or return your order within 14 days, for any reason and without a justification. To be eligible for a return, your item must be in the same condition that you received it, unopened, and in its original packaging. Please email in advance of returning the item. Refund is via the original method of payment. Please include the receipt of purchase within the pack. Our return address is listed below.

Refunds will not be processed until the item is received. We strongly recommend that you use tracked delivery to return your items to us as we are not responsible for items which do not reach us. We do not refund the original shipping costs or cover return postage costs unless the item is proven to be faulty or damaged.

VERY IMPORTANT – All items returned from the UK and outside the EU MUST email in advance specifying which COUNTRY the item is being returned from and wait for instructions relevant to that country. We are unable to refund any customs sales taxes on shipments from/to outside the European Union (EU).

Once the item is received and a Refund is approved, it can take 3-5 working days to be credited to your credit card/original method of payment.

  1. LOST OR DAMAGED

Please inspect your order upon reception and contact us immediately if the item is defective, damaged or if you receive the wrong item, so that we can evaluate the issue and make it right. While we strive to ensure a smooth delivery process, in rare cases, packages may be lost or damaged during transit. If you encounter any issues with your delivery, please reach out to us, and we will work with An Post to resolve the situation.

  1. EXCEPTIONS/ NON-RETURNABLE ITEMS

Certain types of items cannot be returned, like custom products (such as special orders or personalized items). Please get in touch if you have questions or concerns about your specific item.

  1. INTERNATIONAL SHIPPING

Your order may be subject to import duties or taxes, which are incurred once a shipment reaches your destination country. Róisín O’Shea Fine Arts is not responsible for these custom charges if they are applied, and any such import taxes or duties applied must be discharged by you, or the person that you are sending the order to.
